Terms


The internet site www.stergioufamily.gr  (hereinafter referred to as the "internet site" or "webpage" or "website") is an internet site managed by the Société Anonyme under the corporate name "STERGIOU FAMILY FOOD PRODUCTS MANUFACTURING SOCIETE ANONYME" (hereinafter referred to as the "Company"). 

Article 1
Acceptance of Terms of Use by visitors/users 

  1. The browsing and use of the webpage, as well as any information made available through it, implies the express and unconditional consent, assent and agreement of the users/visitors to the following terms, which users/visitors are requested to read carefully and comply with them.
  2. The browsing and use of the webpage, as well as the utilisation of any information provided by it, implies that the user/visitor has studied, understood and accepted all the terms of use.
  3. In case where the user/visitor does not agree with the terms of use of the webpage, he/she must not use the webpage.

Article 2
Purpose of the website

  1. The website was created to provide users with information about the Company and its products.
  2. The website is used "as is", without the possibility of amendments or other interventions by users/visitors.

Article 3
Webpage Use and Access Licence

The Company grants users/visitors a limited licence to access and use the webpage and has the right to withdraw the licence to access and use as well as discontinue the use of the webpage at any time it deems necessary. 

Article 4
Intellectual Property Rights

  1. The webpage and its content (which, indicatively and not restrictively, include texts, logos, trademarks, ideas, advice, graphics, images, photographs, drawings, presentations, videos, audio files, recipes, software, newsletters etc) are the subject matter of the Company's intellectual property and are protected by Greek, EU and international law.
  2. The presentation of the above on the webpage should under no circumstances be considered as a transfer or assignment of a licence or right to use them.
  3. The total or partial copying, reproduction and further use of the content of the webpage is permitted only if it is lawful, if the content has not undergone any modification or alteration, if it is not linked to products not provided by the Company, and provided that the source of its origin is clearly indicated, that it does not cause any confusion to the consumer audience as to its origin and does not harm the Company's reputation and image. 
  4. In any case, the use of material from the webpage for commercial purposes is not permitted without the Company's permission. 

Article 5
Limitation of the Company's Liability

  1. The users/visitors of the webpage agree to use the webpage at their sole initiative and responsibility.
  2. The Company does not guarantee and bears no liability whatsoever for the accuracy and correctness of the content of the webpage, for the existence or non-existence of errors and their correction, for the updating of the content of the webpage, for the continuous availability of the content of the webpage or for the delay or inability to use the webpage or for any errors during the transfer of data or information (file destruction, virus storage, data theft etc). 
  3. The Company is not liable for any claims of a legal nature, civil or criminal, or for any damage to visitors/users of the website or third parties resulting from a cause related to the functioning or non-functioning of the webpage or the use of the webpage and its information or the inability to provide information available from it or related to errors or untimely updating of the webpage content. 
  4. The Company does not guarantee that the webpage, servers or emails sent do not contain viruses or other harmful elements. 
  5. Additionally, the Company is not liable for any damage that may be caused by the use of the Webpage and is the result of the actions of third parties. 
  6. To the fullest extent permitted under applicable law, the Company disclaims any implied guarantee of the matters set forth in this Article.
  7. The Company is not liable for the foregoing even in case of negligence. 
  8. The Company, without prejudice to the foregoing, takes every possible step to ensure the accuracy and correctness of the content of the webpage, to update it, to ensure the uninterrupted functioning of the website and the accessibility of the information on the website and to protect it from viruses and malicious software. 

Article 6
Links to other webpages/websites

  1. In case where the webpage provides now or in the future the possibility of access to third party webpages through links, this will be done exclusively for the convenience of its visitors/users, while the use of these links will be carried out at the sole risk of the visitors/users and the respective webpages will be subject to their own terms of use, for which the Company bears no liability whatsoever.
  2. The Company does not guarantee the availability of the third party internet sites and the placement of the links should not be understood as an endorsement, acceptance or adoption of the content of these pages, nor is the Company liable for their content, the correctness, legality and accuracy of their information, nor for the quality and properties of any products or services, nor for errors or malfunctioning of the third party webpages, nor for the terms of use they use and the privacy policy, nor is the Company liable for any damage caused to the users by the access to and use of these pages.  
  3. The website bears no liability whatsoever neither for the content, services and terms of other internet sites to which the third party websites refer via other links or advertising banners. 

Article 7

Liability-Obligations of users/visitors

  1. Users/visitors must be adults to use the webpage. Use of the webpage automatically implies that the user is an adult. 
  2. The users/visitors accept, agree and covenant that they will proceed with the lawful use of this website, subject, among other things, also to the legislation concerning the transmission of data from Greece to Member States of the European Union and third countries.
  3. The users/visitors of the webpage accept that they will not use the webpage to send, post, publish, email or otherwise transmit any content that is illegal, harmful, threatening, offensive, defamatory or constitutes a violation of the privacy of another person, shows malice or expresses racial, ethnic or other discrimination, that may cause harm to minors in any way, that is not permitted to be transmitted in accordance with the legislation or contractual or managerial relationships, that infringes any patent, trademark, trade secret, copyright or other proprietary rights of third parties, that contains software viruses or any other code, files or programmes, that are designed to interrupt, damage, destroy or prevent the functioning of any software or computer hardware, that intentionally or unintentionally breaches the applicable Greek and Community legislation and its provisions, that may harass third parties in any way and that is used for the collection or storage of personal data of users.
  4. Users/visitors, indicatively and not restrictively, agree that they will not use this internet site to mislead anyone as to the origin of the content of this website, to damage, in any way, the reputation of the owners or third parties, to compromise the security of their network, to prevent any visitor from accessing this website or to circumvent the authentication of their identity, to install and promote, in any way, any kind of unsolicited or unauthorised advertising or unsolicited by the recipient emails (spam), pyramid schemes and any other form of unsolicited content promotion, nor to install and promote advertisements without the written consent of the owners, to install, promote and/or distribute content containing software viruses or any other electronic code, files or programmes designed to interfere with, destroy or limit the functionality of any software or telecommunications equipment, or to prevent other visitors from using the website.
  5. Users/visitors are not permitted to invade and install software viruses or any other code, files or programmes designed to interrupt, damage, destroy or prevent the functioning of any software or computer hardware, intentionally or unintentionally, because any such action violates the applicable Greek and Community legislation and its provisions.
  6. In case of suspicion or establishment of vulnerability of the website, users/visitors are obliged to notify the Company immediately with the information of the incident and to keep but also provide any evidence that may contribute to the investigation of such incidents. Exploitation by users/visitors of any potential security vulnerability of the website is expressly prohibited.
  7. Any illegal activity even if not expressly mentioned above makes the users/visitors of the webpage liable as aforesaid.
  8. Finally, in case where any legal proceedings are brought against the website or against the Company, resulting from any form of infringement by the user/visitor, the user undertakes the obligation, on the one hand, to intervene in the relevant court proceedings in favour of the Company and, on the other hand, to compensate the website and/or the Company, in case where the Company is obliged to pay compensation or other expenses or in case where the user's action has caused any kind of damage to the Company's reputation, otherwise the Company reserves all its legal rights.

Article 8
Electronic Communications

  1. When the user/visitor contacts the Company through the webpage or fills in the contact form present on the webpage or fills in the form for the email address of partners, he/she communicates with the Company electronically.
  2. By such communication, in the above ways, the user/visitor automatically and simultaneously grants his/her express and unconditional consent to the Company to contact him/her electronically, for commercial or non-commercial purposes, for advertising and updates about the Company and its products. 

Article 9
Sending CVs

  1. When the user/visitor fills in the CV submission form present on the webpage and sends/uploads his/her CV, he/she communicates with the Company electronically. 
  2. Following the filling in of the CV submission form and the sending/uploading of the CV, the user/visitor accepts that the Company may contact him/her electronically and/or by telephone and/or in any other way regarding employment positions and/or career opportunities and/or interviews.

Article 10
Newsletters

  1. The webpage gives the user/visitor the opportunity, if he/she so wishes, to receive newsletters of the webpage in his/her email, by submitting the details of his/her email address in the corresponding field of the webpage, and from the moment he/she grants the right to receive newsletters, he/she automatically and simultaneously grants his/her express and unconditional consent for the sending of the website's newsletter to himself/herself.
  2. If the user/visitor ceases to be interested in receiving the newsletters, he/she is given the opportunity to express his/her wish to stop their sending through the relevant electronic newsletter sent to him/her by the webpage.

Article 11
Press releases and website news

  1. This webpage contains press releases and other news or announcements concerning the Company or third parties, which the Company believes to be accurate at the date of their preparation and/or publication on the webpage.
  2. However, the Company undertakes no obligation whatsoever to update such press releases and other news or announcements and/or the information contained therein.
  3. In any case, any information relating to third parties must not be deemed as originating from the Company, but nor should the presentation of such information on the Webpage be considered as an endorsement by the Company as to its accuracy or completeness.

Article 12
Minor users

  1. The use of the website is not intended for minors, namely persons under the age of 18.
  2. Minors are prohibited from visiting the webpage without the supervision of adults, and especially those exercising custody over them.
  3. If minors voluntarily visit the webpage or make use of information accessible through the webpage, which may be deemed inappropriate for or harmful to them, the Company bears no liability whatsoever.

Article 13
Compensation

  1. The Company reserves the right to attribute responsibilities in cases of suspicious or infringing conduct of the users/visitors of the website.
  2. In case of establishment of incorrect use of the website, the Company reserves the right to revoke the access rights of the responsible, possibly certified, user/visitor.
  3. Violation of the Terms of Use or illegal use or misuse of the webpage in any other way entails the liability of the users to compensate the Company for any damage (direct or consequential) arising from or otherwise connected with such violation of the Terms of Use or misuse or illegal use of the webpage, including, but without limitation, as well the costs of any lawyers' fees.
  4. The Company's failure to exercise its rights under these Terms does not constitute a waiver by the Company of its rights as such. 

Article 14
Privacy Protection Policy

An integral and binding part of the Terms of Use is, additionally, also the Privacy Protection Policy which the user/visitor can read on the webpage.

Article 15
Amendment to the Terms 

  1. The Terms of Use of the webpage may be amended, revised and updated at any time, without informing the users/visitors of the webpage, and nor the users/visitors who receive newsletters or who have filled in the contact form with the Company or the CV submission form or who have contacted the Company in any way. 
  2. The sole obligation of the Company is to incorporate, in writing, in this text, any amendment, addition, revision. 
  3. For this reason, each user/visitor must check the Terms of Use at regular periodic intervals. Continued use and browsing of the webpage constitutes acceptance of the applicable Terms of Use in force from time to time. 
  4. The above also applies to the Personal Data Protection Policy and Cookies Policy of the webpage.

Article 16
Validity of Terms - Applicable Law

  1. The Terms of Use of the webpage, as well as any amendment thereto, are governed by national and European law, and any applicable international provisions. 
  2. The Terms of Use constitute a universal agreement between the webpage and the Company and the users/visitors, and this agreement is binding on both sides. 
  3. If it is established that any provision of the above terms is contrary to the aforementioned legal framework or is rendered void or unfair, it automatically ceases to be valid and is removed from the present text, without under any circumstances affecting the validity of the other terms.
  4. The void and inapplicable terms will be replaced by terms that come as close as possible to the meaning and purpose of the void or inapplicable terms.
  5. The users/visitors of the webpage agree that any dispute arising between the users/visitors and the webpage and/or the Company, which is in any way related to the use of the webpage or the information provided through it, will first be attempted to be resolved out of court.
  6. In case this kind of resolution is not achieved, the disputes and all related issues will be resolved by the Courts of Athens.
